On February 22, 2023, the Utah Division of Waste Management and Radiation Control (Division) announced its intent to deny Promontory Point Resources, LLC’s (PPR) application to reclassify its facility from a Class I municipal waste to a Class V commercial waste facility.
PPR had requested the reclassification in order to enable it to store out-of-state waste – specifically large quantities of California Hazardous Waste – on the shores of Great Salt Lake, at the tip of Promontory Point. In its application, PPR argued that the “need” for additional Class V capacity should be based on economics rather than physical space within existing landfills. The Director of the Division disagreed, determining that there were hundreds of years – as much as 350 years – worth of available capacity within multiple facilities close to PPR’s facility, and that there was no need for additional capacity.
The Division will accept public comments on the Director’s intent to deny the application through Monday, April 10. Email comments must be sent to dwmrcpublic@utah.gov and must include the subject line: “Public Comment on Promontory Point Class V Landfill.”
